Article 1. Applicability

These general Terms & Conditions apply to all offers, orders and agreements on Shajan.nl. By accepting an offer or placing an order, you agree with the applicability of these conditions. These conditions respect the rights of the consumer that come forth from the law (or the sales-agreement). You also agree with the general conditions of Shajan.nl.  

Article 2. Offers/Agreements

All offers on Shajan.nl are without obligation and Shajan.nl expressly reserves the right to alter prices, particularly when this is necessary based upon (legal) requirements.
An agreement is only concluded once Shajan.nl has accepted your order. The order-confirmation that is automatically sent does not count as an acceptation of your order.
Shajan.nl has the right to refuse orders or to add certain conditions to the delivery, such as prepayment or partial prepayment, unless expressly stated otherwise. If an order is refused, Shajan.nl will notify the customer of this within ten (10) days after receipt of the order.

Article 3. Prices and Payments

The prices for the products and services on offer are in Euro’s, including VAT and excluding shipping, taxes or other charges unless specified or agreed otherwise.
The payment is to take place by means of one of the methods offered by us. If your payment is not made within the prescribed period, you are in default from the day that the payment should have taken place, and from that day on you are to pay statutory default interest per month or part of a month over the outstanding amount.

If you have not paid after notice of the claim within the prescribed period, we wil pass the claim on to a collection agency. In the event that we are forced to pass the claim on to a collection agency, we will charge an extra 25,00 administration fee.
In case of payment by bank or giro, the date of crediting of the giro or bank account of Shajan.nl counts as the date of payment.

If Shajan.nl outsources its claim for collection, you also owe the collection costs, which are at least fifteen percent (15%) of the outstanding amount with a minimum of 35 Euro, without prejudice to the competence of Shajan.nl to recover the extrajudicial costs that were made instead.

These costs are additional to the invoice amount and the administrative costs that we may have charged. In case of (type) errors in the prices, Shajan.nl reserves the right to charge you the correct price. However, in this case, you will be contacted beforehand, and you have the right to terminate the agreement in written form within five (5) days.

Article 4. Delivery
The delivery times specified by Shajan.nl are only indications. Exceedence of a delivery time does not give you any right to compensation. The maximum delivery time is 30 days unless agreed otherwise. If this delivery time is not feasible, we will notify you timely and provide you with the opportunity to terminate the agreement. Payments that have already been made will be refunded within 30 days.

The delivery of products takes place at the place and time on which the products are ready to be dispatched. Shajan.nl reserves the right to deliver orders in parts if necessary (this will be judged by Shajan.nl). In this case, you will not be charged any additional postage costs.

Article 5. Retention of Ownership

The ownership of products is transferred to you once you have paid Shajan.nl everything you owe based upon the agreement made. The risk in respect of the products is transferred to you upon delivery..

Article 6. Intellectual and Industrial property rights

You must comply with all intellectual and industrial property rights that are connected with the products provided by Shajan.nl. Shajan.nl guarantees that the products delivered do not infringe any (unwritten) intellectual and/or industrial property rights of third parties.

Article 7. Special offers and Liability

Upon delivery, you have the obligation to examine whether all the products meet the requirements of the agreement. If this is not the case, you are to notify Shajan.nl of this matter as soon as possible, within seven (7) week days after the delivery, or after this finding was reasonably possible, in written form including a justification.
If it is demonstrated that the product(s) do not meet the requirements, Shajan.nl may choose to replace the products in question upon return, or to offer a restitution of the purchase price.
If you, for whatever reason, do not wish to accept a certain product, you have the right to return the product in question to Shajan.nl within seven (7) weekdays after delivery.
Returning a product is only possible if you have notified Shajan.nl and received a confirmation from Shajan.nl beforehand. Returned products will only be accepted if they are returned unworn, unused, intact, packaged properly (bubble-wrap envelopes are usually not suitable) and sufficiently stamped (we do not accept unstamped packages), which means that the postage costs are at your own expense.
Shajan.nl will examine the returned products upon receipt and pay you back the purchase price minus the shipping costs if this is necessary. Under no circumstances can Shajan.nl be held liable for any damage caused directly or indirectly by use of products delivered by Shajan.nl.
Use of products provided by Shajan.nl is entirely at your own risk. From a hygenic point of view, returning lingerie and erotic toys is not possible.

Article 8. Orders/communication
Shajan.nl can not be held liable for misunderstandings, mutations, delays or incorrect transmission of order information due to use of the Internet or any other means of communication between you and Shajan.nl, or between Shajan.nl and third parties to the extent that these relate to the relationship between you and Shajan.nl.
This is unless it regards a matter of intention or gross negligence by Shajan.nl. Messages, notices and other communication will take place by e-mail. The client is responsible for providing Shajan.nl with a correct e-mail address for communication with the customer at all times.

Article 9. Force Majeure

Without prejudice to it’s own rights, Shajan.nl has the right, in case of a force majeure situation, to suspend or terminate the execution of your order, or to terminate the agreement without judicial intervention, and to notify you of the matter in written form using the e-mail address that you have provided. In this case, Shajan.nl is not obliged to any form of compensation unless this would be unacceptable considering the circumstances and the standards of reasonability and fairness. Majeure means any circumstance that can not be attributed to Shajan.nl, and that Shajan.nl can not be accounted for under any law, act or movement.

Article 10. Miscellaneous
If you provide Shajan.nl with an address in written form, Shajan.nl has the right to send all orders to this address, unless you have provided Shajan.nl with an alternative address which you would like your orders to be sent to. If Shajan.nl allows certain deviations from these conditions (whether or not implied) for a shorter or longer period of time, this does not affect her right to demand immediate and strict compliance with these conditions. You can never do justice to any subject on the grounds that Shajan.nl does not apply these conditions strictly. Shajan.nl has the right to make use of third parties in order to execute your order(s). Shajan.nl has the right to alter these conditions, and in this case the old conditions will expire.

Article 11. Applicable Law and Jurisdiction

On all rights, obligations, offers, orders and agreements to which these conditions apply, only Dutch law is applicable. All disputes between parties will be submitted to the competent court in the Netherlands.
